FAQ
Options include: (1) informal restructuring with creditors, (2) filing under Section 10 of the IBC for voluntary insolvency, (3) raising emergency bridge financing, or (4) an M&A sale. Early legal counsel is critical — Advocate Pallavi can assess the situation and recommend the least disruptive path.
Yes. The NCLT Bengaluru Bench has jurisdiction over all companies registered in Karnataka. A creditor (financial or operational) can file at Bengaluru regardless of whether the company's registered office is in Whitefield, Electronic City, or Mangaluru.
Under Section 9 of the IBC, operational creditors (including IT vendors, consultants, and contractors) can initiate CIRP when a company defaults on unpaid invoices exceeding ₹1 crore. A demand notice must first be served; if unresolved in 10 days, an application can be filed at the NCLT.
